El profesional consideró que está impedido para pronunciarse sobre el asunto objeto de revisión, por estar incurso en las causales previstas en los numerales 1 y 4 del artículo 56 del Código de Procedimiento Penal.
Esto, por ser el apoderado de una AFP y haber intervenido, precisamente, en el proceso de tutela de la referencia.
Al encontrar acreditado que la imparcialidad del conjuez se ha comprometido y que en su caso particular presenta un interés actual, especial y personal sobre la resolución del caso, la Sala Plena de la Corporación ACEPTÓ el impedimento propuesto por el doctor Guerrero Pérez.
